Welcome to Point Taken. These Terms & Conditions govern your use of the Point Taken website and your purchase of products from Point Taken.

By accessing this website, creating an account, placing an order, or purchasing a product from Point Taken, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website or place an order.

1. About Point Taken

Point Taken offers a carefully selected collection of knives, swords, axes, throwing knives, throwing stars, throwing blades, collectibles, accessories, and related merchandise. Our goal is to offer unique, interesting, high-quality products at highly affordable prices. Throughout these Terms, “Point Taken,” “we,” “our,” and “us” refer to Point Taken and its owners, operators, employees, and authorized representatives.

2. Age Requirements

You must be at least 18 years old and legally permitted to purchase, possess, and receive the product you are ordering. Some products, locations, or jurisdictions may have additional age requirements. Point Taken reserves the right to request proof of age or identification before processing or releasing an order. We may cancel any order if we are unable to reasonably verify eligibility.

Laws regarding knives, swords, automatic knives, throwing knives, throwing stars, axes, and other edged products can vary significantly by state, county, city, municipality, and other jurisdiction. It is the purchaser’s responsibility to understand the laws that apply where the product will be purchased, received, possessed, carried, transported, displayed, or used. A product being displayed for sale on our website does not necessarily mean that it may legally be purchased, shipped, carried, or possessed in every location. Point Taken reserves the right to: restrict certain products from being shipped to particular locations; require additional verification before shipping an order; refuse or cancel an order when we believe the transaction may violate applicable law or shipping regulations; modify shipping restrictions as laws and carrier requirements change. If an order must be canceled because the product cannot legally or reasonably be shipped to the destination provided, the applicable purchase amount will be refunded.

4. Responsible Ownership and Use

Knives, swords, axes, throwing blades, throwing stars, and similar products are potentially dangerous items and should always be handled responsibly. By purchasing from Point Taken, you agree to use, store, transport, and maintain products safely and lawfully. Products sold by Point Taken are not toys. You are responsible for: proper handling and storage; keeping products away from children and unauthorized users; using appropriate safety equipment and precautions; using throwing products only in appropriate and safe environments; following manufacturer instructions and warnings; and complying with all applicable laws regarding possession, transportation, carrying, and use. Point Taken does not encourage or condone the unlawful, reckless, threatening, or dangerous misuse of any product we sell.

5. Product Descriptions and Images

We make reasonable efforts to accurately describe and photograph our products. However, colors, finishes, patterns, handle materials, packaging, markings, blade appearance, and other details may occasionally vary slightly from photographs shown on the website. Manufacturers may also make product changes without notice. Measurements and weights should be considered approximate unless specifically stated otherwise. If we discover a significant error in a product description, price, photograph, or specification after an order has been placed, we may contact you for instructions or cancel the affected portion of the order and issue an appropriate refund.

6. Availability

We specialize in unique products, limited quantities, unusual finds, and merchandise that may change frequently. For that reason, availability is not guaranteed. An item appearing on the website does not guarantee that it remains in stock at the time an order is processed. If an item becomes unavailable after you place an order, we may: contact you with alternative options; remove the unavailable item from your order and refund it; or cancel and refund the affected order. We will not substitute a materially different product without your approval.

7. Pricing

All prices are listed in U.S. dollars unless otherwise stated. Point Taken reserves the right to change prices, promotions, discounts, and product availability at any time. We attempt to ensure that prices displayed on the website are accurate. However, errors may occasionally occur. If an obvious pricing error occurs, Point Taken reserves the right to cancel the affected order and issue a refund rather than honor an incorrectly displayed price. Applicable sales tax, shipping charges, and other required charges will be calculated during checkout where applicable.

8. Orders and Payment

Submitting an order does not guarantee acceptance of that order. Point Taken reserves the right to refuse or cancel an order for legitimate reasons including, but not limited to: product availability; suspected fraud; payment problems; incorrect pricing; age-verification issues; shipping restrictions; legal restrictions; errors in product information; quantity limitations; or other circumstances that make fulfillment unreasonable or unlawful. Payment must be successfully authorized before an order is processed. If an order that has already been paid must be canceled by Point Taken, the applicable amount will be refunded to the original payment method whenever reasonably possible.

9. Shipping

Orders will be shipped using the methods and carriers available through Point Taken. Shipping estimates are estimates and are not guarantees of a particular delivery date unless expressly stated otherwise. Point Taken will make reasonable efforts to ship orders within any timeframe stated on the website. If we are unable to ship an order within the promised timeframe, we will handle the delay, cancellation, or refund in accordance with applicable law. Certain products may be restricted from shipment through particular carriers or to particular destinations. Point Taken may change the shipping method, refuse shipment, or cancel a product or order when necessary to comply with applicable laws, carrier requirements, or safety requirements. Customers are responsible for providing an accurate and complete shipping address.

10. Delivery and Lost or Damaged Packages

Once a shipment has been transferred to the carrier, delivery is subject to the carrier’s procedures and policies. If an order arrives damaged, contains the wrong product, or appears to have been lost in transit, please contact Point Taken promptly so we can investigate the issue. Do not discard damaged merchandise, packaging, labels, or shipping materials until the issue has been resolved, as photographs or packaging may be required for a carrier claim. Point Taken will make reasonable efforts to assist customers with legitimate shipping problems.

11. Returns and Refunds

Returns, exchanges, and refunds are governed by the Point Taken Return & Refund Policy displayed on our website. Customers should review that policy before completing a purchase. Some merchandise may be ineligible for return due to condition, use, customization, clearance status, safety considerations, manufacturer restrictions, or other circumstances identified in the Return & Refund Policy. Nothing in these Terms is intended to eliminate any consumer right that cannot legally be waived.

12. Product Condition and Inspection

Customers should inspect products carefully upon receipt and before use. Do not use a product if it appears damaged, defective, loose, cracked, improperly assembled, or otherwise unsafe. Throwing knives, throwing axes, throwing stars, swords, and similar products are subject to impact, wear, and stress during use. They should be inspected before and after use. Normal wear, edge wear, scratches, cosmetic damage, damage resulting from impact, improper use, improper sharpening, alteration, abuse, or failure to properly maintain a product may not constitute a product defect.

13. Assumption of Risk

The purchaser understands that edged tools and weapons can cause serious injury, property damage, or death when improperly handled or used. By purchasing and using these products, you accept the ordinary risks associated with their lawful possession and use. To the fullest extent permitted by law, Point Taken is not responsible for injury, damage, loss, or liability resulting from the misuse, unlawful use, reckless use, unauthorized modification, improper storage, improper maintenance, or use of a product contrary to its intended purpose or manufacturer instructions. Nothing in this section limits liability that cannot legally be limited or excluded.

14. Third-Party and Manufacturer Products

Many products sold by Point Taken are manufactured by third parties. Manufacturer names, trademarks, product names, logos, and other intellectual property remain the property of their respective owners. Where a manufacturer provides a warranty, that warranty may be subject to the manufacturer’s own terms and claim procedures. Point Taken does not automatically provide additional manufacturer warranties unless specifically stated.

15. Website Use

You may use the Point Taken website only for lawful purposes. You may not: attempt to interfere with the operation or security of the website; attempt to gain unauthorized access to customer accounts, systems, databases, or administrative areas; use automated systems to improperly scrape or extract website content; submit fraudulent orders or payment information; use the website for unlawful activity; or copy or commercially exploit Point Taken branding, original photographs, graphics, written content, or other protected materials without permission.

16. Intellectual Property

Unless otherwise stated, the Point Taken name, branding, logos, website design elements, original photographs, written content, promotional materials, graphics, and other original materials are owned by or licensed to Point Taken. These materials may not be reproduced, distributed, modified, sold, or commercially used without written permission from Point Taken.

17. Promotions and Blade of the Week

Point Taken may periodically offer special promotions, discounts, limited-quantity products, Blade of the Week offers, contests, giveaways, or other special programs. Additional rules or restrictions may apply to individual promotions. Promotions may be modified or discontinued at any time unless prohibited by applicable law. Discounts and promotional offers may not be combined unless specifically stated.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Point Taken will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or misuse of products purchased from Point Taken or from use of the website. Any limitation of liability contained in these Terms applies only to the extent permitted by law. Nothing in these Terms is intended to waive or limit rights or liabilities that cannot legally be waived or limited.

These Terms & Conditions and transactions with Point Taken will be governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction’s mandatory consumer-protection laws require otherwise. Any legal action relating to these Terms will be brought in a court of competent jurisdiction in Connecticut unless applicable law requires a different venue.
